Referral Rewards

1. About the program
The Club Paradiso Referral Rewards Program (the "Program") is offered by SPG Land Pty Ltd (the "Promoter") in connection with the sale of new residential apartments at Paradiso Place, Gold Coast, Queensland (the "Project").
The Program rewards eligible members of the Club Paradiso community who introduce a new buyer that goes on to purchase an apartment at Paradiso Place and settles that purchase in accordance with these Terms & Conditions ("Terms").
By participating in the Program, you agree to be bound by these Terms.

2. Eligibility

2.1 Who can refer (Referrers)
You are eligible to refer a buyer to Paradiso Place only if you are, at the time of the referral and at settlement:
• an existing purchaser of an apartment at Paradiso Place (contract exchanged and deposit paid); or
• a holder of a signed Expression of Interest (EOI) for Paradiso Place; or
• a registered Club Paradiso VIP member invited in writing by the Promoter.
Employees, directors, officers and immediate family of the Promoter, SPG Land, and any appointed sales or marketing agency for the Project are not eligible to participate as Referrers.
You must not hold, and do not need to hold, a real-estate licence to participate. Referrers act as introducers only and must not represent, negotiate, or act as agent on behalf of any buyer or the Promoter, and must not carry on the business of buying, selling, exchanging, or letting real estate in the meaning of the Property Occupations Act 2014 (Qld).

2.2 Who can be referred (Referred Buyers)
A Referred Buyer must:
• not be an existing lead, enquiry, contact, EOI holder, or purchaser recorded on the Promoter's CRM (Property Base / Salesforce) at the time the referral is submitted;
• not be represented by, or introduced by, another agent, buyer's agent, channel partner, or introducer in relation to the Project;
• be legally able to purchase residential property in Australia, including complying with any FIRB approval requirements that apply to them.

3. How to make a valid referral
To make a valid referral, the Referrer must, before the Referred Buyer has any contact with the Paradiso Place sales team:
• Fil in the referral form and submit the Referred Buyer's full name, mobile number, email address, and a brief note of interest via or by emailing referrals@paradisoplace.com.au;
• obtain the Referred Buyer's consent to being contacted by Paradiso Place before submitting their details, in accordance with Australian privacy and spam laws;
• receive an email acknowledgement from the Promoter confirming the referral has been logged in the CRM against the Referrer.
A referral is only considered valid once the Promoter has confirmed the acknowledgement in writing. Verbal, social-media, or informal introductions without a logged CRM record will not qualify for a reward.

4. Priority and attribution
Where more than one Referrer, agent, or channel partner claims introduction of the same buyer, the following order of priority applies:
• the first party to submit the buyer's details to Property Base (system-timestamped) is treated as the introducing source, unless the Promoter determines in its reasonable discretion that another source is properly attributed;
• appointed channel agents holding a signed Form 6 for the buyer take precedence over Club Paradiso Referrers;
• an existing lead already recorded in the CRM cannot be re-introduced.
The Promoter's decision on attribution is final. Rewards are paid to one Referrer per Referred Buyer only.

5. Reward — what you receive
If a Referred Buyer:
• purchases an apartment at Paradiso Place under an unconditional contract;
• completes settlement of that apartment in accordance with the contract; and
• does not rescind, terminate, or fall out of the contract for any reason prior to settlement,
then the Referrer will receive a reward equal to 0.5% (zero point five per cent) of the GST-inclusive purchase price recorded on the contract of sale (the "Referral Reward"), paid in two equal instalments as set out in clause 6 below.
Worked examples of the Referral Reward are shown below. These are illustrative only; the actual reward is calculated from the executed contract price and paid in two equal instalments (see clause 6).

The Referred Buyer does not receive a discount, rebate, credit, or benefit at settlement under this Program. The purchase price is the price agreed under the contract of sale.

6. When the reward is paid
The Referral Reward is paid to the Referrer as Visa prepaid gift cards (each an "Instalment"), delivered by post or in person to the Referrer's nominated address:
• the first Instalment (50% of the Referral Reward) is payable within 30 business days after the Referred Buyer has (a) signed an unconditional contract of sale for an apartment at Paradiso Place and (b) paid a 10% deposit that has cleared into the vendor's trust account ("Contract Instalment");
• the second Instalment (the remaining 50% of the Referral Reward) is payable within 30 business days after unconditional settlement of the Referred Buyer's apartment ("Settlement Instalment").
If the contract is cancelled, terminated, rescinded, does not settle, or is transferred, novated, or assigned to a party who is not the original Referred Buyer after the Contract Instalment has been paid, the Referrer must repay the Contract Instalment to the Promoter within 14 business days of written demand. The Settlement Instalment is only payable if the original Referred Buyer completes settlement.

7. Tax, GST, and payment obligations
The Referral Reward is paid to the Referrer in a personal capacity. The Referrer is solely responsible for:
• declaring the reward as assessable income where required by law;
• any GST obligations if the Referrer is (or should be) registered for GST — where GST applies, a valid tax invoice must be issued to the Promoter before payment; and
• providing an Australian Business Number (ABN) or a completed Statement by a Supplier form; the Promoter may otherwise be required to withhold tax at the highest marginal rate.
The Referrer must obtain their own independent tax and financial advice. Nothing in these Terms is tax advice.

8. Limits and exclusions
• The Program applies to new sales only. Contracts already in the sales pipeline or already introduced by an appointed agent at the time of referral are excluded.
• The Referral Reward is not available in conjunction with a real-estate agent's commission on the same sale. A Referrer who is a licensed real-estate agent must instead be engaged under a written Form 6 agency appointment and paid under that appointment, not under the Program.
• The Promoter reserves the right to exclude any referral where it reasonably believes the Referrer has misrepresented themselves as an agent, provided misleading information to the Referred Buyer, or acted in a manner inconsistent with these Terms.
• There is no cap on the number of buyers a Referrer may refer, unless the Promoter notifies the Referrer otherwise in writing.

9. Referrer conduct
The Referrer must not:
• hold themselves out as an agent, employee, or representative of the Promoter, SPG Land, or the Project;
• provide advice about price, valuation, finance, tax, FIRB status, or investment returns to any Referred Buyer — all such enquiries must be directed to the Paradiso Place sales team and the buyer's own independent advisers;
• use paid advertising, portals (e.g. realestate.com.au, Domain), classifieds, or any marketing material that references Paradiso Place without the Promoter's prior written consent;
• send unsolicited electronic messages in breach of the Spam Act 2003 (Cth) or personal information in breach of the Privacy Act 1988 (Cth).
Breach of this clause may result in disqualification from the Program and forfeiture of any unpaid Referral Reward.

10. Privacy
Personal information collected under the Program is handled in accordance with the Promoter's Privacy Policy. By submitting a referral, the Referrer confirms they have obtained the Referred Buyer's consent to disclosure of their personal information to the Promoter for the purpose of being contacted about Paradiso Place, and to storage of that information in the Promoter's CRM.

11. Program changes and duration
The Promoter may vary, suspend, or terminate the Program at any time on 14 days' written notice to registered participants. Valid referrals lodged and acknowledged before a change or termination will be honoured on the terms in force at the time the referral was acknowledged.

12. Disputes and governing law
The Promoter's decision on all matters relating to the Program — including eligibility, attribution, and payment — is final. These Terms are governed by the laws of Queensland, Australia, and each party submits to the non-exclusive jurisdiction of the Queensland courts.

13. Definitions
• "Contract" means the contract of sale for an apartment at Paradiso Place.
• "CRM" means the Promoter's customer relationship management system, currently Property Base on Salesforce.
• "Form 6" has the meaning given in the Property Occupations Act 2014 (Qld).
• "Settlement" means completion of the Contract in accordance with its terms.
